By accessing or using Union Cab's services, website, or mobile application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services. These Terms constitute a legally binding agreement between you and Union Cab.

Service Description

Union Cab provides a technology platform that connects passengers with independent drivers for transportation services in Honolulu, Hawaii. Our services include:

• Fixed-rate ride booking and scheduling
• Real-time ride tracking and communication
• Secure payment processing
• Customer support services
• Multi-language support (English and Korean)

User Accounts and Registration

To use our services, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use
• Accept responsibility for all activities under your account

You may not create multiple accounts or share your account with others. We reserve the right to suspend or terminate accounts that violate these Terms.

Booking and Payment Terms

Booking Process

• All bookings are subject to driver availability
• Fare estimates are provided upfront with fixed pricing
• You must provide accurate pickup and drop-off information
• Special requests should be noted during booking
• Bookings can be cancelled according to our cancellation policy

Payment Terms

• Payment is processed securely through Stripe
• All fares are fixed rates with no surge pricing
• Additional fees may apply for special services or wait times
• Refunds are processed according to our refund policy
• You are responsible for all charges incurred on your account

Cancellation Policy

• Free cancellation up to 15 minutes before pickup time
• Cancellation fees may apply for late cancellations
• No-show fees apply if you fail to appear for your ride
• Weather or safety-related cancellations are handled case-by-case

User Conduct and Responsibilities

When using our services, you agree to:

• Treat drivers and other users with respect and courtesy
• Follow all applicable laws and regulations
• Provide accurate information for bookings
• Be ready at the designated pickup time and location
• Wear seatbelts and follow safety instructions
• Not engage in illegal activities during rides
• Not damage vehicles or property
• Not harass, threaten, or discriminate against others

Prohibited Activities

• Using the service while under the influence of drugs or alcohol
• Smoking or vaping in vehicles
• Bringing prohibited items (weapons, illegal substances, etc.)
• Attempting to defraud or manipulate the platform
• Interfering with driver operations or vehicle controls
• Recording drivers or other passengers without consent

Driver Relationship

Important: Union Cab drivers are independent contractors, not employees. This means:

• Drivers set their own schedules and availability
• Union Cab facilitates connections but does not control driver actions
• Drivers are responsible for their own vehicle maintenance and insurance
• Union Cab is not liable for driver actions outside our platform
• Disputes with drivers should be reported through our support system

Liability and Insurance

Insurance Coverage

Union Cab maintains commercial insurance coverage that applies during active rides. This coverage includes:

• Liability coverage for bodily injury and property damage
• Uninsured/underinsured motorist coverage
• Coverage applies from pickup to drop-off

Limitation of Liability

To the maximum extent permitted by law, Union Cab's liability is limited to the amount paid for the specific ride in question. We are not liable for:

• Indirect, incidental, or consequential damages
• Lost profits, data, or business opportunities
• Actions of independent contractor drivers
• Service interruptions or technical issues
• Third-party actions or property

Intellectual Property

Union Cab owns all rights to our platform, including:

• Software, applications, and technology
• Trademarks, logos, and branding
• Content, data, and analytics
• Trade secrets and proprietary information

You may not copy, modify, distribute, or reverse engineer our platform without permission.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to our data practices as described in the Privacy Policy.

Dispute Resolution

We encourage resolving disputes through our customer support team first. For unresolved disputes:

• Disputes will be resolved through binding arbitration
• Arbitration will be conducted in Honolulu, Hawaii
• Hawaii state law governs these Terms
• Class action lawsuits are waived
• Small claims court remains available for qualifying disputes

Service Modifications and Termination

Union Cab reserves the right to:

• Modify, suspend, or discontinue services at any time
• Update pricing, features, or service areas
• Terminate user accounts for Terms violations
• Refuse service to any user at our discretion
• Change these Terms with appropriate notice

Force Majeure

Union Cab is not liable for service interruptions caused by events beyond our reasonable control, including natural disasters, government actions, labor disputes, technical failures, or other force majeure events.

Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Union Cab regarding our services.
